TrainerMatch Terms of Service (Clients & Trainers)

Entity: TrainerMatch, a DBA of Health Performance Systems, LLC (“TrainerMatch,” “we,” “our,” or “us”)
By creating an account or using the TrainerMatch platform (the “Platform”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Platform.
1. OVERVIEW & PLATFORM ROLE TrainerMatch is a technology directory and communications platform that connects clients (“Clients”) with independent fitness and clinical professionals (“Trainers”) for discovery purposes.
- TrainerMatch does not employ, manage, supervise, or control Trainers and does not provide fitness, medical, or wellness services directly.
- TrainerMatch’s role is strictly limited to facilitating discovery and initial communication. We are not a party to any subsequent coaching agreements, liability waivers, or financial transactions for training services rendered between the Client and the Trainer.
2. USER ELIGIBILITY Users must be at least 18 years old and legally able to enter binding agreements. By registering, you represent that all information you provide is accurate and complete. TrainerMatch may suspend or terminate accounts containing false or misleading information.
3. ACCOUNT RESPONSIBILITIES You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to notify TrainerMatch immediately of any unauthorized use or suspected breach of security. TrainerMatch is not liable for any loss or damage arising from your failure to secure your account.
4. PLATFORM RULES All users agree to:
- Engage respectfully, lawfully, and professionally.
- Avoid discrimination, harassment, or unsafe behavior.
- Use the Platform solely for legitimate professional discovery and training-related inquiries.
- For Trainers: Accurately represent all credentials, certifications, and specialties. TrainerMatch reserves the right to suspend or terminate accounts violating these rules, including accounts that spam users or misrepresent professional qualifications.
5. PAYMENTS, FEES & FUTURE MONETIZATION
- Training Services: TrainerMatch currently operates as a discovery directory. We do not process payments, collect transaction fees, or hold funds in escrow for coaching sessions. All financial arrangements, billing, and refunds for fitness services are handled independently and directly between the Client and the Trainer outside of the TrainerMatch platform. TrainerMatch cannot mediate financial disputes between users.
- Future Platform Fees: TrainerMatch reserves the right to introduce subscription fees, verification fees, premium visibility tiers, or other platform charges in the future. Users will be provided reasonable advance notice of any new fees or changes to the platform’s pricing structure prior to those charges taking effect.
6. REVIEWS AND ENDORSEMENTS Clients may leave reviews or qualitative endorsements on Trainer profiles. Reviews must reflect genuine experiences and may not contain false, misleading, or defamatory content. Trainers and Clients may not manipulate the review system. TrainerMatch reserves the right to remove or restrict reviews that violate these terms or applicable laws.
7. THIRD-PARTY SERVICES TrainerMatch integrates with third-party tools (including mapping software). Your use of these services is subject to their respective terms and privacy policies. TrainerMatch is not responsible for the performance or actions of third-party providers.
8. ASSUMPTION OF RISK & LIMITATION OF LIABILITY To the maximum extent permitted by law:
- TrainerMatch and Health Performance Systems, LLC shall not be liable for any injuries, damages, medical complications, or losses resulting from training sessions, communications, or user conduct originating from the Platform.
- All fitness and rehabilitation activities involve inherent risks, and Clients participate at their own risk. Clients are solely responsible for evaluating the qualifications of a Trainer and obtaining necessary medical clearance directly with the Trainer prior to beginning any program.
- TrainerMatch provides the Platform “as is” and makes no warranties of any kind, express or implied.
- In no event shall TrainerMatch’s total liability to you for all damages exceed one hundred US dollars ($100.00).
9. INDEMNIFICATION You agree to defend, indemnify, and hold harmless TrainerMatch, Health Performance Systems, LLC, and their officers, employees, and affiliates from any claims, losses, damages, liabilities, and expenses (including attorneys’ fees) arising out of or related to:
- Your use of the Platform or participation in training sessions;
- Your violation of these Terms; or
- Your violation of the rights of another user or third party.
10. TERMINATION TrainerMatch may suspend or terminate your account at any time for violations of these Terms, fraud, misconduct, or at its sole discretion to protect platform integrity. You may terminate your account at any time through your profile settings.
11. MODIFICATIONS TrainerMatch may modify these Terms at any time. Updated Terms will be posted on the Platform with the “Effective Date” revised. Continued use of the Platform after such changes constitutes acceptance of the updated Terms.
12. GOVERNING LAW & ARBITRATION These Terms are governed by the laws of the Commonwealth of Massachusetts. Any dispute arising under or related to these Terms shall be resolved by binding arbitration under the rules of the American Arbitration Association. Each party waives the right to a jury trial and agrees that arbitration is the exclusive remedy for dispute resolution.
13. NO WARRANTY; PLATFORM DISCLAIMER TrainerMatch does not guarantee continuous, error-free, or secure operation of the Platform. Use of the Platform is at your sole risk. TrainerMatch disclaims all warranties, express or implied, including fitness for a particular purpose, accuracy, or availability.
14. ENTIRE AGREEMENT These Terms, along with the Trainer Agreement and Privacy Policy, constitute the entire agreement between you and TrainerMatch and supersede all prior understandings or agreements.
